Terms and conditions of business

Please read these Terms and Conditions carefully as the following details outline the conditions under which we will do business together. ‘Do you need a Writer’ reserves the right to change and update any rates and any of the Terms and Conditions at any time and without prior notice. These Terms and Conditions supersede any previous Terms and Conditions distributed in any form and in accepting them you agree to be bound by any modifications, alterations and updates.

Throughout these Terms and Conditions, ‘Do you need a Writer’, ‘We’ or ‘Us’ refers to ‘You’ or ‘Your’ means you, the person agreeing to these Terms and Conditions and any company on behalf of which you claim authorisation to act.

When you contract ‘Do you need a Writer’ to write for you, you acknowledge that these Terms and Conditions take precedence over any other Terms and Conditions, express or implied, and regardless of whether it is your normal practice to conduct similar engagements under your own Terms and Conditions.

1. General terms of agreement

1.1 ‘Do you need a Writer’ will provide writing services as agreed and set out in communications with you, be these written, verbal or via email.

1.2 A job will be judged to have been contracted when you send us an email in which you clearly indicate that you wish us to proceed with the work, at a fee you have agreed with us during the course of our correspondence.

1.3 Your acceptance of this correspondence and instruction to commence work will be deemed to be agreement to these Terms and Conditions, regardless of whether or not this agreement has been given in writing, via email or verbally.

1.4 Should the work you contracted be on behalf of a third party, you agree to indemnify us against any claim by your third party client for compensation or damages brought about as a direct or indirect result of the use, or inability to use, the material which we write for you.

1.5 Timeframes, deadlines or appointed milestones will be agreed before commencement of each project. Whilst we try hard to ensure each deadline is met, should the rare occasion arise that given timeframes will not be adhered to you will be notified of this no less than 24 hours before the relevant deadline is due.

1.6 In the unlikely event of a deadline being missed, you agree to indemnify us against any claim by you or any third party for compensation or damages brought about as a direct or indirect result of this.

1.7 You acknowledge that we may, from time to time, use the services of a consultant copywriter to help us deliver all or part of the work which you require. In such a case, the produced work would be supervised by ‘Do you need a Writer’ to ensure that any work is of the quality you would expect had we written it in its entirety.

1.8 Unless explicitly indicated otherwise by you in writing, any work produced by ‘Do you need a Writer’ will be available for use on our website, as a case study or in other promotional material to act as testimonial or examples of our work and reference can be made to you as a client of

1.9 All work shall be invoiced shortly after the first draft copy has been sent to you. The payment due date is not altered by reason of any subsequent amendments or alterations that may be required. Where work is sent across in stages or at prearranged milestones we reserve the right to send staggered invoices as each stage is completed.

1.10 Alterations and amendments shall be undertaken in good faith to ensure you are happy with the content you receive. Where a change to the overall content specification is introduced that significantly alters the initial brief, we reserve the right to charge additional fees according to the amount of extra work created.

2. Payment

2.1 Our standard payment terms are 14 days from the date of invoice, unless expressly agreed otherwise in writing.

2.2 Payment may be made by online bank transfer (i.e. BACS), cash or cheque. Payment by credit card is possible subject to prior arrangement. Arrangement should be made within a suitable timeframe to ensure payment by the chosen method is received into our account by the due date.

2.3 Any returned cheques will incur an additional fee of £50 per returned cheque and ‘Do you need a Writer’ reserves the right to consider an account to be in default in the event of a returned cheque.

2.4 Should you require any change or additional information to be shown on an invoice prior to payment, you should request this within sufficient time to complete payment by the due date.

2.5 If the entity to be invoiced is not a UK Limited Company we may, at our discretion, ask you to pay the project fee in whole or in part in advance of the commencement of work.

2.6 The existence of an ‘end of following month’ payment practice in your company’s handling of accounts payable will in no way alter your obligation to make payment to us on the due date shown on our invoice.

2.7 Where payment is not received by the due date we reserve the right to charge interest. This will be applied at a rate of 8% per month, plus the prevailing Bank of England base rate. By way of example, the current Bank of England base rate (as at August 2015) stands at 0.5%, making a current total chargeable interest rate of 8.5% per month for the duration of time that your account remains in arrears. As the base rate changes so will the overall rate of chargeable interest.

3. Copyright

3.1 On receipt of payment as set out in paragraph 2 above ‘Do you need a Writer’ will assign to you all copyright in relation to the work we have written for you. Prior to full payment being made the copyright is retained by

3.2 You accept all responsibility for any copyright issues arising from the publication of content produced by us that summarises, rephrases or otherwise refers to third party sources.

3.3 We reserve the right to use reasonable extracts of the copy produced in the promotion of unless explicitly agreed otherwise or explicitly requested by you in writing.

4. Limitations

4.1 Whilst we make every effort to ensure the work we provide you with is free of errors, omissions, literals, misrepresentations, spelling mistakes, inaccurate implications and other inaccuracies, the final responsibility for published material remains with you. And as such you absolve us of any responsibility for any costs incurred or liability of any kind for any loss or damage, whether material, financial, commercial or reputational, that you may incur as a result of the appearance of such errors in the final published form.

4.2 No variation to these Terms and Conditions will be effective unless agreed in writing by ‘Do you need a Writer’.

4.3 These Terms and Conditions are governed by the laws of England and Wales and the courts of England and Wales will have exclusive jurisdiction.
